These terms and conditions (the “Terms and Conditions”) govern the use of www.phone.exchange(the “Site”). This site is owned and operated by PhoneExchange Pty Ltd. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Proterty.
All content published and made available on our Site is the property of PhoneExchange Pty Ltd and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

When you create an account on our Site, you agree to the following:
1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

These Terms and Conditions are governed by the laws of the State of Victoria.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

TERM OF USE

1. Selling devices
- By sending a mobile device(s), Customer is deemed to have accepted the Terms & Conditions of PhoneExchange Pty Ltd which can be found at www.phone.exchange.
- By sending a mobile device(s) to PhoneExchange, Customer declares that he or she is the sole and lawful owner of the mobile device being sold.
- By sending a mobile device(s), Customer agrees that he or she will forfeit all of his or her legal rights (both proprietary and contractual rights) in relation to the device if the device handed in turns out to be lost, stolen, fabricated or counterfeited.
- By sending a mobile device(s), Customer agrees that he or she already has backed up all personal data stored on the device and factory-reset the device. In the event of receiving a phone that has not been properly reset, Customer agrees that PhoneExchange may choose to factory-reset the device without any form of permission from Customer.
- PhoneExchange will not take liability for any sort of damage(s) incurred during the delivery of a mobile device via postage. It is incumbent on Customer to ensure that the device arrives safely to PhoneExchange’s office. PhoneExchange advises that Customer pay a premium at the courier’s office for peace of mind.
- Any offer or quotation made on PhoneExchange’s website is not final and is subject to final inspection by one of our technicians. This is why, if one of our technicians conclude that the device is either water-damaged or physically damaged, or that the device does not match the initial condition report conducted by Customer, PhoneExchange may modify or withdraw its original offer.
- PhoneExchange keeps the right to withdraw or rescind its online offer during any stage of the transaction.

2. Buying devices
- A customer will be deemed to have agreed to the following terms of the warranty policy of PhoneExchange by entering into a transaction.
- The warranty policy is displayed in our shop as well as on our website at www.phone.exchange.
- Every pre-owed mobile phone sold by PhoneExchange comes with a three-months warranty effective from the date of purchase.
- Warranty can be provided in one of the following ways, as PhoneExchange thinks appropriate considering all the circumstances of the case, (i) repair, (ii) exchange or (iii) full refund.
- Before returning a phone for warranty, the customer must ensure that the phone has been factory reset. PhoneExchange may refuse to provide any warranty if the phone is locked in any manner.
- PhoneExchange may refuse to provide any warranty if the phone that has been returned for warranty is physically damaged. Physical damage includes, but is not limited to, screen glass damage, LCD damage and water damage.
- It is incumbent on a customer, not PhoneExchange, to thoroughly inspect the phone before purchase and to ensure that the phone is free from any physical damage including LCD damage.
- PhoneExchange guarantees to Customer that all our pre-owned phones are genuine in a sense that all the core parts of a phone (motherboard, camera and RAM) are original and genuine. However, some replaceable parts of a phone, for example battery or LCD, may not be original.
- Customer is not entitled to an automatic right to refund or exchange on the ground of change of mind. PhoneExchange will have full discretion as to whether or not it will allow refund or exchange after considering all the circumstances of the case.
- Receipt must be provided at all times for either warranty or refund.
- PhoneExchange does not guarantee about the water-proof functionality of any phone.
- Every mobile phone that has been repaired by PhoneExchange at the request of a customer comes with a three-months warranty from the date of repair. However, the warranty is strictly limited to the specific part or module that had actually been repaired or replaced.
- Customer has obligation to back up their personal data before coming in for repair. This is due to the fact that every repair job entails some degree of risk.
- The phone may lose its water-proof functionality once it has been repaired.
